TRAFFIC DIVERSION AND OTHER TRAFFIC POLICIES
Individuals receiving moving violation tickets have one of three options available to resolve the matter.
OPTION ONE—Diversion
There are certain basic requirements to qualify for traffic diversion. If you have a Commercial Driver’s
License you are not eligible for this option. You must request and be approved for diversion prior to any
trial date that is currently set for your appearance.
YOU ARE NOT ELIGIBLE FOR DIVERSION IF:
1. You have a moving violation conviction on your driving record right now.
2. You have an accident showing on your driving record right now.
3. At this time, you were ticketed for more than one moving violation.
4. At this time, your ticket was a result of an accident you were involved in.
5. If you were charged with speeding and your are exceeding the speed limit by more
than 19 miles an hour.
6. At this time, you have received a moving violation in a construction zone, school
zone or involving a school bus.
7. You have received a traffic diversion in the past.
8. You have a Commercial Driver’s License.
If you do not have any of the above conditions present you might be eligible for diversion. In order to
determine whether diversion is available, a TRAFFIC DIVERSION APPLICATION must be filled out and
submitted to the City Attorney’s Office. AN APPLICATION FEE ($25.00) IS REQUIRED.
PLEASE NOTE: If you are 16 years of age or younger and driving on a restricted license—and are
eligible for diversion—you should be aware that one of the provisions of the diversion agreement is
submission of your driver’s license for two weeks within the first month of the diversion agreement.
TOTAL COST OF DIVERSION—You must pay the $25.00 diversion application fee at the time
application is submitted, the $100.00 diversion maintenance fee and the entire cost of the ticket must be
paid when diversion agreement is signed and returned.
OPTION TWO—Have a trial
If diversion is not an option, you can request a trial. You may appear in court and request a trial. PLEASE
NOTE: Having a trial does not cost any more than paying the ticket outright.
OPTION THREE—Pay the ticket
You may, at any time, pay the amount shown on the back of the ticket.
